Website Development Contract
1) Design Interview
We need to get to the bottom of who you are, what you stand for, and who you stand beside. Only then can we begin to create a design that portrays the value you offer in a way that resonates with the people who matter: the people you want to do business with.
1) Domain Information/Registration
If you have already purchased your domain name we will need the log-in information and provider you purchased through.
If you have not already purchased a domain name, we will check if the domain you desire is available. A domain name can be purchased through your hosting provider and is recommended.
2) Hosting Credentials
Once we both agree that we are a good fit to develop your website, we will need your hosting account login and/or Cpanel username and password. I will set this up if you do not already have a hosting account.
You will have the option to purchase the hosting of your choice. I recommend bluehost.com and their Choice Plus plan. They offer a free Domain Name for 1st year, free SSL Certificate, 1-click WordPress Installation, and 24/7 customer support.
If you prefer a faster, dedicated server and want to sign-up for Walter Websites Hosting Package you can get access to our virtual private server. This means your website won’t be competing for shared resources over a giant server with hundreds of other websites but will have its own virtual space. 3) WordPress Installation
Once your domain and hosting accounts are purchased, we will install WordPress and set up your administrator login. We will want to collect a username and password that you can remember/use to log into the WordPress Dashboard (The place you will manage your website).
What I will need to get started:
1) Your Logo
Your logo (PDF, EPS, or high res, JPEG or PNG if possible)
If you currently do not have a logo we can help you design a logo that will be a point of recognition for clients and an important foundation for the branding of your company. This service is an additional cost.
However, there are many online logo creation software services out there if you choose to design your own logo.
2) Images & Pictures
Current and/or new images and pictures you’d like to use on the new website.
Page content and any updated verbiage/information for the website.
We also offer content creation services if you need us to create custom content that appeals to your buyers’ persona.
These items can be uploaded to your google drive account and shared with me via email.
1) Layout and Design
A large and time consuming part of designing a website is in the planning and layout stage of the process. I’ll create the sitemap (Page/Menu hierarchy) of the website for approval first, then I’ll design the home page and sub page for approval.
Once the site layout and design is approved, I’ll move forward with designing all site pages and implementing all functionality and plugins. We’ll make sure your site looks great and is fully responsive before moving to the final step.
3) Edits & Revisions
Once the site is ready for final review, you’ll be able to review each page and we can make detailed edits until the site is ready for launch. We ask that you please review ALL pages to make sure all spelling, grammar, addresses and information are correct before going live.
Once the site is ready to go live, all unnecessary plugins, pages, images and back-end files will be removed. The new site will be backed up and saved locally, should it ever need to be restored. Once live, it may take between 24-48 hours for the new site to pull up on some devices. Your browser may need to be refreshed in order to see the new site, though most will see the new site fairly quickly after the launch.
Your website login and all credentials will be sent to you. Though your logins and passwords will be saved by me locally, PLEASE SAVE ALL LOGINS FOR YOUR RECORDS AS WELL. Upon completion, you’ll receive a link to my information on our Maintenance Plan which I highly recommend for all my clients.
A separate invoice will be sent out after the Design Interview detailing specific pricing based on the website scope. You will sign this invoice and agree to pay the amount due. The following are typical cost catagories.
Depending on the scope of the project this price could range from $500-$10,000+
Standard WordPress Plugins are usually free and provide basic functionality and will vary depending on your websites needs. These are included in pricing.
Premium WordPress Plugins offer advanced website functionality and have a cost. The costs range from monthly/yearly memberships to one-time payments. The cost of these premium plugins will be worked into the final pricing.
I offer and highly recommend a WordPress maintenance plan. These plans vary based on term length and scope.
I offer logo and branding services. This services cost will depend on the scope of branding required.
We can create content for your website that will truly make a big impact for you and your audience. These costs will vary based on the scope of the request.
You, [customer name] are hiring Walter Websites to design and develop a website for the estimated total price outlined in the “Your Investment” portion of this proposal.
As my customer, you have the power and ability to enter into this contract on behalf of your company or organization. You agree to provide me with everything that I need to complete the project including text, images, fonts and other information as and when I need it, and in the format that I ask for. You agree to review my work, provide feedback, and sign-off approval in a timely manner and are bound by any deadlines that we set together. You also agree to keep to the payment schedule set out in this proposal.
I have the experience and ability to perform the services you need and I will carry them out in a professional and timely manner. I will endeavor to meet all the deadlines set, but am not responsible for a missed launch date or deadline if you have been late in supplying materials or have not approved my work on time at any stage. I will also maintain the confidentiality of any information that you give me.
I will create designs for the look, layout, and functionality of your website. This contract includes one main design and one opportunity for you to make revisions to the final design and pages. If you are not happy with the design at that point, I will provide you with an additional quote for extra design work needed. If instead, you wish to cancel our agreement, you may do so and I will retain the initial payment for the work completed to date.
I will develop page templates through the WordPress Dashboard. I will also test to ensure that these pages will display visually in a similar—not necessarily an identical—way in website browsers, tablets, and phone screens.
I am not responsible for writing or inputting any text copy. I will be happy to help, but significant work on my part will result in a charge above and beyond the original price. This will not be done without your approval of an additional quote provided in advance.
If needed, you will supply me photographs either in digital or printed format. If you choose to buy stock photographs that price will be added to the initial quote. Stock photography will not be purchased without your written and or verbal approval.
The estimated/quoted prices in this proposal are based on the time I estimate I will need to accomplish everything that you have told me you want to achieve. If you do want to change your mind, add extra pages or templates, or even add new functionality, that won’t be a problem. At that time you will be provided with an additional quote for the extra work.
As agreed, the quote provided includes the installation and set up of your site on your server as well as the implementation of basic search engine optimization. Updates to, and management of that server, plus any support issues will be up to you.
I do not offer or include technical support for website hosting, email, or other services relating to website hosting unless you purchase hosting through Walter Websites. If you do require help with anything beyond the design and development of your site, I will be happy to help.
I am not liable to you or any third party for damages, including lost profits, lost savings, or other incidental, consequential or special damages arising out of the operation of or inability to operate this website and any other web pages—even if you have advised me of the possibilities of such damages.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
You guarantee to me that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide me for inclusion in the website are either owned by you or that you have permission to use them.
When I receive your final payment, copyright is automatically assigned as follows:
You own the graphics and other visual elements that I create for you for this project. I will give you a copy of all files and you should store them carefully as I am not required to keep them or provide any native source files that I used in making them.
You also own text content, photographs, and other data you provided unless someone else owns them. I own the the web page builder plugin and theme provided to you which is accessed through your WordPress Dashboard. You will have access to the plugin as long as you are in good standing with Walter Websites. After we hand off the website and administrative access to you we are no longer responsible for changes made with the page builder. However, if you need additional assistance, at that time you will be provided with an additional quote for the extra work.
I also reserve the right to display and link to your completed project as part of my portfolio and to write about the project on websites, in magazine articles, and in books.
As agreed, our payment schedule will be as follows but may be revised based on further conversations between us.
100% of total fee upon agreement of initial design.
Interest accrued if payment is more than 14 days late. We reserve the right to add 5% to any outstanding balance every 7 days, starting from the 15th day after receipt of the finished product.
You cannot transfer this contract to anyone else without my permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place.
